Agreement to Terms

By accessing or using FuelSport ("we," "our," or "us") services available at app.fuelsport.ai and api.fuelsport.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

FuelSport is an athlete nutrition and performance tracking platform that provides:

  • Performance test data management and analysis
  • Sweat test tracking and analysis
  • Nutrition planning and fuel plan creation
  • Workout planning and tracking
  • Route management and GPS file storage
  • Coach-athlete relationship management
  • Food database and nutrition tracking

Account Registration

Eligibility

  • You must be at least 13 years old to use the Service
  • You must provide accurate, current, and complete information during registration
  • You must maintain and update your information to keep it accurate, current, and complete
  • You are responsible for maintaining the confidentiality of your account credentials

Account Types

The Service supports three account types:

  • Athlete: Primary users who track their own performance and nutrition data
  • Coach: Users who can view and analyze data for athletes who have accepted their coaching invitation
  • Admin: System administrators with full access for support and system management

Account Security

  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account
  • We are not liable for any loss or damage arising from your failure to protect your account credentials

Email Verification

  • You must verify your email address before accessing the Service
  • Verification links expire after 60 minutes
  • If you do not receive a verification email, check your spam folder or contact support

User Responsibilities

Acceptable Use

You agree to:

  • Use the Service only for lawful purposes
  • Provide accurate and truthful information
  • Respect the privacy and rights of other users
  • Comply with all applicable laws and regulations
  • Not interfere with or disrupt the Service or servers

Prohibited Activities

You agree NOT to:

  • Violate any applicable local, state, national, or international law
  • Transmit any viruses, malware, or harmful code
  • Attempt to gain unauthorized access to any part of the Service
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Upload content that infringes on intellectual property rights
  • Upload content that is illegal, harmful, or offensive

Content and Data

Your Content

  • You retain ownership of all content and data you upload to the Service
  • You grant us a license to use, store, and process your content to provide the Service
  • You are responsible for ensuring you have the right to upload any content you submit

Uploaded Files

  • PDF Files: Performance test reports you upload may be processed using third-party services (CloudConvert, OpenAI) for data extraction
  • GPX/FIT Files: Route files you upload are stored securely and associated with your account
  • You are responsible for ensuring uploaded files do not contain malicious code or violate any laws

Food Database

  • The food database contains both global (public) and private (user-specific) foods
  • You may create custom foods marked as private
  • Global foods are shared across all users
  • You are responsible for the accuracy of custom food entries you create

Data Accuracy

  • We strive to provide accurate data and calculations
  • Performance metrics, nutrition calculations, and recommendations are provided "as-is"
  • You are responsible for verifying critical information independently
  • We are not liable for decisions made based on data provided through the Service

Coach-Athlete Relationships

Coach Access

  • Coaches can only access athlete data after the athlete explicitly accepts a coaching invitation
  • Athletes can revoke coach access at any time
  • Coaches must respect athlete privacy and use data only for coaching purposes
  • Coaches may not share athlete data with third parties without explicit consent

Athlete Responsibilities

  • Athletes are responsible for the accuracy of data they share with coaches
  • Athletes should communicate any concerns about coach access promptly

Relationship Termination

  • Either party may terminate a coach-athlete relationship at any time
  • Upon termination, the coach loses access to the athlete's data
  • Historical data shared during the relationship may remain in activity logs for record-keeping

Intellectual Property

Our Intellectual Property

  • The Service, including its design, features, and functionality, is owned by FuelSport
  • All trademarks, logos, and service marks are our property
  • You may not use our intellectual property without prior written permission

Your Intellectual Property

  • You retain ownership of content you upload
  • By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content as necessary to provide the Service

Third-Party Content

  • The Service may include content from third-party sources (e.g., USDA nutrition database)
  • Such content is subject to the terms and licenses of the respective third parties

Service Availability and Modifications

Service Availability

  • We strive to maintain Service availability but do not guarantee uninterrupted access
  • The Service may be unavailable due to maintenance, updates, or unforeseen circumstances
  • We are not liable for any loss or damage resulting from Service unavailability

Service Modifications

  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time
  • We may add, remove, or modify features without prior notice
  • We will make reasonable efforts to notify users of significant changes

Feature Deprecation

  • We may deprecate features with reasonable notice
  • You will be notified of feature deprecations and given time to export your data

Disclaimers

Medical and Health Disclaimer

IMPORTANT: The Service provides nutrition and performance tracking tools for informational purposes only. The Service is NOT:

  • A substitute for professional medical advice, diagnosis, or treatment
  • Intended to diagnose, treat, cure, or prevent any disease
  • A replacement for consultation with qualified healthcare professionals

You should:

  • Consult with healthcare professionals before making significant changes to your nutrition or training
  • Not rely solely on Service recommendations for medical decisions
  • Seek immediate medical attention for health emergencies

Performance Data Disclaimer

  • Performance metrics and calculations are estimates based on available data
  • Actual performance may vary from predictions
  • We are not responsible for performance outcomes based on Service recommendations

Third-Party Services

  • The Service integrates with third-party services (email providers, PDF processors, AI services, nutrition APIs)
  • We are not responsible for the availability, accuracy, or practices of third-party services
  • Your use of third-party services may be subject to their respective terms and privacy policies

Limitation of Liability

General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100 IF YOU HAVEN'T PAID ANYTHING)

Data Loss

  • We implement reasonable backup and recovery procedures
  • We are not liable for data loss due to circumstances beyond our reasonable control
  • You are responsible for maintaining backups of critical data

Service Interruptions

  • We are not liable for interruptions, delays, or failures in the Service
  • We are not liable for loss of data or inability to access your account

Indemnification

You agree to indemnify, defend, and hold harmless FuelSport and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another user or third party
  • Content you upload or transmit through the Service

Account Termination

Termination by You

  • You may terminate your account at any time by contacting support
  • Upon termination, your access to the Service will be disabled
  • Data may be retained for a reasonable period for backup and recovery purposes

Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent, abusive, or illegal activity
  • You fail to pay required fees (if applicable)
  • We are required to do so by law
  • We discontinue the Service

Effect of Termination

  • Upon termination, your right to use the Service immediately ceases
  • We may delete or retain your data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination will remain in effect

Dispute Resolution

Informal Resolution

  • We encourage you to contact us first to resolve any disputes informally
  • Contact support@fuelsport.ai with any concerns

Governing Law

  • These Terms are governed by the laws of the State of Colorado, United States
  • Any disputes will be resolved in the courts of Colorado

Class Action Waiver

  • You agree to resolve disputes individually
  • You waive any right to participate in class actions or consolidated proceedings

Changes to Terms

Modifications

  • We may modify these Terms at any time
  • Material changes will be notified via email or prominent notice on the Service
  • Continued use of the Service after changes constitutes acceptance

Review

  • You are responsible for reviewing these Terms periodically
  • The "Last Updated" date indicates when Terms were last revised

Miscellaneous

Entire Agreement

  • These Terms, together with our Privacy Policy, constitute the entire agreement between you and FuelSport
  • They supersede all prior agreements and understandings

Severability

  • If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect

Waiver

  • Our failure to enforce any provision does not constitute a waiver
  • Any waiver must be in writing and signed by us

Assignment

  • You may not assign or transfer your account or these Terms without our prior written consent
  • We may assign these Terms without restriction

Acknowledgment

By using the Service, you acknowledge that:

  • You have read and understood these Terms
  • You agree to be bound by these Terms

  • You have the legal capacity to enter into this agreement

If you do not agree to these Terms, you must not use the Service.
